Welcome to Qalamekahani. By accessing our website, reading stories, buying coins, subscribing to premium plans, or submitting content, you agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use our services.

We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the website following any changes constitutes your acceptance of the new terms.

2. Writer Agreement & Legal Liability

Neutral Venue: Qalamekahani acts solely as an interactive, neutral online platform hosting user-generated stories, books, audio files, and articles. We do not edit, modify, or verify the ownership of content published by writers prior to upload.

Absolute Liability: Writers carry 100% sole and absolute legal and financial liability for any content they upload or publish, including but not limited to all text, audio series, descriptions, and cover art images.

  • Intellectual Property & Plagiarism: By uploading, the writer warrants that they own all copyrights, trademarks, and proprietary rights to the submitted material or have obtained explicit, legally binding written permission from the original owner. Plagiarism or unauthorized distribution is strictly prohibited.
  • Offensive Content & Legal Liability: Content that contains hate speech, obscenity, defamation, threats, harassment, copyright infringements, or violates any active laws of India or international treaties is strictly forbidden. Writers are solely responsible for any legal actions or penalties resulting from such violations.
  • Indemnification: The writer agrees to fully indemnify, defend, and hold harmless Qalamekahani, its founders, developers, employees, and affiliates from and against any and all claims, lawsuits, damages, liabilities, losses, costs, and expenses (including reasonable attorney fees) arising directly or indirectly from their published content.
  • Moderation: Qalamekahani reserves the right, at its absolute discretion, to suspend accounts or delete content instantly without prior notice if copyright infringement or terms violation is reported or suspected.

3. Payment, Coins & Subscription Policy

All prices listed are in Indian Rupees (INR) unless stated otherwise. Payments are securely processed through third-party payment gateways (Razorpay, UPI, Cards, Net Banking).

  • Premium Content Access: Standard users can access free previews (e.g., first chapter of stories, or limited episodes of audio series). Locked chapters require wallet coins or an active premium monthly subscription to unlock.
  • Premium Subscriptions: Active monthly premium subscription plans grant unlimited, ad-free access to all stories and audio stories. Subscriptions do not require individual coin unlocks during the active period.
  • Coin Wallet: Wallet coins are used to unlock specific chapters permanently. Purchased coins are strictly non-refundable and non-transferable under any circumstances.

4. Shipping & Delivery Policy

We provide both physical merchandise (books) and digital subscriptions:

  • Digital Deliverables: Digital content, including unlocked chapters, eBooks, and audio series, is delivered immediately online and accessible via your account panel upon successful payment.
  • Physical Books: Standard shipping takes 5-7 business days depending on location. Orders are processed within 1-2 business days. Shipping rates will be computed at checkout.

5. Cancellation & Refund Policy

Please review our refund parameters before completing payments:

  • Digital Items: There are no refunds or cancellations for premium monthly subscriptions, wallet coins, or digital unlocks.
  • Physical Books: Cancellations are permitted only before shipment. If a physical book is received damaged or defective, you may submit a return/replacement claim with proof within 7 days of delivery to bilalnandoliya60@gmail.com.

6. Privacy Policy

Your privacy is important. We only collect necessary authentication credentials and billing information to complete transactions. Your profile data is stored securely and never shared with third parties for promotional marketing.

कलमेकहानी (Qalamekahani) में आपका स्वागत है। इस वेबसाइट का उपयोग करके, कहानियाँ पढ़ने, कॉइन खरीदने, प्रीमियम प्लान सब्सक्राइब करने, या अपनी सामग्री अपलोड करके, आप इन नियमों और शर्तों से पूरी तरह सहमत होते हैं। यदि आप इन शर्तों से असहमत हैं, तो कृपया हमारी सेवाओं का उपयोग न करें।

हम बिना किसी पूर्व सूचना के समय-समय पर इन शर्तों को संशोधित करने का अधिकार सुरक्षित रखते हैं। वेबसाइट के निरंतर उपयोग का अर्थ है कि आपने नई शर्तों को स्वीकार कर लिया है।

2. लेखक समझौता और कानूनी दायित्व

तटस्थ मंच (Neutral Venue): कलमेकहानी केवल लेखकों की कहानियों, पुस्तकों, ऑडियो और आर्टिकल्स को होस्ट करने के लिए एक तटस्थ मंच (neutral venue) के रूप में कार्य करता है। हम किसी भी सामग्री को प्रकाशित होने से पहले संपादित या स्वामित्व की जाँच नहीं करते हैं।

पूर्ण कानूनी दायित्व: लेखक अपने द्वारा अपलोड या प्रकाशित की गई सभी सामग्रियों (जैसे पाठ, ऑडियो, चित्र, कवर आर्ट, और कहानियों के विवरण) के लिए 100% कानूनी और वित्तीय रूप से जिम्मेदार हैं।

  • कॉपीराइट और साहित्यिक चोरी: सामग्री अपलोड करके, लेखक यह सुनिश्चित करता है कि उसके पास उस सामग्री के सभी कॉपीराइट और बौद्धिक संपदा अधिकार हैं, या उसने मूल मालिक से कानूनी लिखित सहमति प्राप्त की है। साहित्यिक चोरी (plagiarism) या अनधिकृत शेयरिंग सख्त वर्जित है।
  • अपमानजनक सामग्री: ऐसी सामग्री जो घृणास्पद भाषण, अश्लीलता, मानहानि, धमकी, उत्पीड़न फैलाती हो, या किसी भारतीय या अंतर्राष्ट्रीय कानूनों का उल्लंघन करती हो, पूर्णतः प्रतिबंधित है। ऐसे उल्लंघन के परिणामस्वरूप होने वाली सभी कानूनी कार्रवाइयों के लिए लेखक स्वयं उत्तरदायी होगा।
  • क्षतिपूर्ति (Indemnification): लेखक कलमेकहानी, उसके संस्थापकों, टीम के सदस्यों, डेवलपर्स और सहयोगियों को उसके द्वारा प्रकाशित सामग्री के कारण होने वाले किसी भी कानूनी दावे, मुकदमे, क्षति, नुकसान, या वकील की फीस सहित खर्चों से पूरी तरह मुक्त (indemnify) रखने के लिए सहमत है।
  • सामग्री हटाना (Moderation): कॉपीराइट शिकायत या नियमों के उल्लंघन की शंका होने पर कलमेकहानी के पास बिना किसी सूचना के सामग्री को तुरंत हटाने या लेखक का खाता निलंबित करने का पूर्ण अधिकार सुरक्षित है।

3. भुगतान, कॉइन और सब्सक्रिप्शन नीति

सभी कीमतें भारतीय रुपये (INR) में हैं। लेनदेन सुरक्षित ऑनलाइन गेटवे (Razorpay, UPI, कार्ड और नेट बैंकिंग) के माध्यम से संसाधित किया जाता है।

  • प्रीमियम सामग्री एक्सेस: उपयोगकर्ता मुफ्त प्रीव्यू (जैसे कहानी का पहला अध्याय, या ऑडियो के सीमित एपिसोड) देख सकते हैं। लॉक किए गए अध्यायों को खोलने के लिए वॉलेट कॉइन्स या एक्टिव मासिक प्रीमियम सब्सक्रिप्शन की आवश्यकता होती है।
  • प्रीमियम सब्सक्रिप्शन: सक्रिय मासिक प्रीमियम प्लान के साथ उपयोगकर्ता विज्ञापन-मुक्त तरीके से सभी प्रीमियम कहानियों और ऑडियो को असीमित रूप से एक्सेस कर सकते हैं।
  • कॉइन वॉलेट: अध्यायों को स्थायी रूप से अनलॉक करने के लिए खरीदे गए वॉलेट कॉइन्स किसी भी स्थिति में वापस (non-refundable) या ट्रांसफर नहीं किए जा सकते।

4. शिपिंग और डिलीवरी नीति

हम डिजिटल सब्सक्रिप्शन और भौतिक पुस्तकें दोनों प्रदान करते हैं:

  • डिजिटल उत्पाद: भुगतान सफल होने के तुरंत बाद अनलॉक सामग्री, ई-बुक्स, और ऑडियो आपके खाते में ऑनलाइन उपलब्ध हो जाते हैं।
  • भौतिक पुस्तकें: आपके स्थान के आधार पर मानक शिपिंग में 5-7 कार्य दिवस लगते हैं। आर्डर 1-2 दिनों में प्रोसेस किए जाते हैं।

5. रद्दीकरण और रिफंड नीति

भुगतान पूरा करने से पहले कृपया हमारी रिफंड शर्तों की समीक्षा करें:

  • डिजिटल आइटम: मासिक प्रीमियम सब्सक्रिप्शन, वॉलेट कॉइन, या डिजिटल अनलॉक के लिए कोई रिफंड या कैंसिलेशन संभव नहीं है।

6. गोपनीयता नीति

1. સામાન્ય શરતો

કલમેકહાની (Qalamekahani) માં આપનું સ્વાગત છે. અમારી વેબસાઇટનો ઉપયોગ કરીને, વાર્તાઓ વાંચીને, કોઈન્સ ખરીદીને, પ્રીમિયમ પ્લાન સબસ્ક્રાઇબ કરીને, અથવા તમારી સામગ્રી અપલોડ કરીને, તમે આ નિયમો અને શરતોથી બંધાવા માટે સંમત થાઓ છો. જો તમે આ શરતો સ્વીકારવા તૈયાર ન હોવ તો, કૃપા કરીને અમારી સેવાનો ઉપયોગ કરશો નહીં.

2. લેખક કરાર અને કાનૂની જવાબદારી

તટસ્થ માધ્યમ (Neutral Venue): કલમેકહાની લેખકોને તેમની વાર્તાઓ, પુસ્તકો, ઓડિયો અને આર્ટિકલ્સ પ્રકાશિત કરવા માટે માત્ર એક તટસ્થ પ્લેટફોર્મ (neutral venue) પૂરું પાડે છે. અમે અપલોડ થતા પહેલા સામગ્રીના માલિકી હક્કની ચકાસણી કે સંપાદન કરતા નથી.

સંપૂર્ણ કાનૂની જવાબદારી: લેખક પોતે અપલોડ કે પ્રકાશિત કરેલી તમામ સામગ્રી (જેમ કે લખાણ, ઓડિયો, છબીઓ, કવર આર્ટ, અને વાર્તાના વર્ણન) માટે ૧૦૦% કાનૂની અને નાણાકીય રીતે જવાબદાર છે.

  • કોપીરાઇટ અને સાહિત્યિક ચોરી: સામગ્રી અપલોડ કરીને, લેખક ખાતરી આપે છે કે તેમની પાસે તે સામગ્રીના તમામ કોપીરાઇટ અને બૌદ્ધિક સંપદા અધિકારો છે, અથવા તેમણે મૂળ લેખક પાસેથી લેખિત પરવાનગી મેળવી છે. સાહિત્યિક ચોરી (plagiarism) કે ગેરકાનૂની નકલ સખત પ્રતિબંધિત છે.
  • વાંધાજનક સામગ્રી: એવી સામગ્રી કે જે નફરત ફેલાવતી હોય, અશ્લીલ હોય, બદનક્ષીકારક હોય, કે કોઈપણ ભારતીય કે આંતરરાષ્ટ્રીય કાયદાનો ભંગ કરતી હોય, તે સંપૂર્ણપણે પ્રતિબંધિત છે. આ પ્રકારના ઉલ્લંઘનથી થતી કોઈપણ કાનૂની કાર્યવાહી માટે લેખક પોતે જ જવાબદાર રહેશે.
  • નુકસાનીથી મુક્તિ (Indemnification): લેખક કલમેકહાની, તેના સ્થાપકો, ડેવલપર્સ અને ટીમના સભ્યોને તેમના દ્વારા અપલોડ કરેલી સામગ્રીથી થતા કોઈ પણ કાનૂની કેસો, નુકસાની, કે વકીલની ફી સહિતના ખર્ચાઓથી સંપૂર્ણપણે મુક્ત (indemnify) રાખવા માટે સંમત થાય છે.
  • સામગ્રી હટાવવી (Moderation): કોપીરાઇટ ભંગની ફરિયાદ અથવા કોઈ શંકા જણાય તો કલમેકહાની પાસે કોઈ પણ પૂર્વ સૂચના આપ્યા વિના સામગ્રીને તાત્કાલિક હટાવવાનો અથવા લેખકનું એકાઉન્ટ સ્થગિત કરવાનો સંપૂર્ણ અધિકાર છે.

3. ચુકવણી, કોઈન્સ અને સબસ્ક્રિપ્શન નીતિ

તમામ કિંમતો ભારતીય રૂપિયા (INR) માં છે. ઓનલાઇન ચુકવણી સુરક્ષિત ગેટવે (Razorpay, UPI, કાર્ડ અને નેટ બેંકિંગ) દ્વારા પ્રોસેસ થાય છે.

  • પ્રીમિયમ સામગ્રી એક્સેસ: વાચકો મફત પ્રિવ્યૂ (દા.ત. પ્રથમ પ્રકરણ અથવા ઓડિયોના મર્યાદિત એપિસોડ) મેળવી શકે છે. લોક થયેલા પ્રકરણો વાંચવા માટે વોલેટ કોઈન્સ અથવા સક્રિય માસિક પ્રીમિયમ સબસ્ક્રિપ્શન હોવું જરૂરી છે.
  • પ્રીમિયમ સબસ્ક્રિપ્શન: સક્રિય માસિક પ્રીમિયમ સબસ્ક્રિપ્શન ધારકોને બધી પ્રીમિયમ વાર્તાઓ અને ઓડિયો જાહેરાતો વગર અમર્યાદિત જોવા મળે છે.
  • કોઈન વોલેટ: ચેપ્ટર કાયમ માટે અનલોક કરવા ખરીદેલા વોલેટ કોઈન્સ કોઈપણ સંજોગોમાં પરત (non-refundable) કે ટ્રાન્સફર કરી શકાશે નહીં.

4. શિપિંગ અને ડિલિવરી નીતિ

અમે ડિજિટલ અને ભૌતિક બંને પ્રકારની પ્રોડક્ટ પ્રદાન કરીએ છીએ:

  • ડિજિટલ સામગ્રી: સફળ ચુકવણી પછી તરત જ અનલોક કરેલ સામગ્રી, ઈ-બુક્સ, અને ઓડિયો તમારા એકાઉન્ટ પેનલમાં ઓનલાઇન ઉપલબ્ધ થાય છે.
  • ભૌતિક પુસ્તકો: સરનામાં અનુસાર ડિલિવરીમાં ૫ થી ૭ દિવસનો સમય લાગે છે. ઓર્ડર ૧ થી ૨ દિવસમાં પ્રોસેસ કરવામાં આવે છે.

5. રદ કરવા અને રિફંડની નીતિ

ચુકવણી પૂર્ણ કરતા પહેલા કૃપા કરીને રીફંડની શરતો તપાસો:

  • ડિજિટલ આઇટમ્સ: પ્રીમિયમ સબસ્ક્રિપ્શન, વોલેટ કોઈન કે ડિજિટલ અનલોક પર કોઈ રિફંડ કે રદ્દીકરણ નીતિ ઉપલબ્ધ નથી.
  • ભૌતિક પુસ્તકો: શિપમેન્ટ પહેલાં જ ઓર્ડર રદ કરી શકાય છે. જો કોઈ ભૌતિક પુસ્તક નુકસાનગ્રસ્ત મળ્યું હોય તો ડિલિવરીના ૭ દિવસમાં પુરાવા સાથે bilalnandoliya60@gmail.com પર રિપ્લેસ કે રિફંડ માટે સંપર્ક કરો.

6. પ્રાઈવસી પોલીસી
